Terms of Service

1. Introduction

These Terms of Service (the "Terms") govern your access to and use of Hard Money Lenders of Nashville (the "Site"), operated by Lead Skills, LLC ("we," "our," or "us"). By accessing or using the Site, or submitting an inquiry, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

These Terms apply to all visitors and users of the Site.

2. Our Role: Lead Generation Service

The Site is a lead-generation service that connects borrowers with participating hard money lenders who may be able to provide financing. We do not make loans, extend credit, take loan applications, issue loan commitments, set rates or terms, or make any credit decisions. All credit decisions, including approval, rates, terms, fees, disclosures, and funding timelines, are the sole responsibility of the participating lender.

Submitting an inquiry does not guarantee that you will be matched with a lender or receive a loan offer. All loan programs are subject to borrower and property qualification by the participating lender.

3. No Offer or Solicitation

Information presented on the Site is for general informational purposes only and does not constitute an offer, solicitation, commitment, or advice to lend, borrow, buy, or sell any financial product. Rates, terms, and conditions vary by lender and are subject to change without notice. Not all applicants will qualify.

4. Eligibility

To use the Site, you represent and warrant that you:

• Are at least 18 years of age and legally able to enter into a binding contract;
• Will provide accurate, current, and complete information in any inquiry you submit;
• Are submitting information about yourself or on behalf of a person who has authorized you to do so; and
• Are not prohibited from using the Site under applicable law.

5. Your Consent to Be Contacted

By checking the consent box on the inquiry form and clicking Submit, you provide your prior express written consent for one or more participating lenders to contact you at the phone number and email address you provided, including by autodialer, prerecorded or artificial voice, SMS/text message, and email, regarding your financing inquiry. You understand your information will be shared with one or more participating lenders who may contact you.

Consent is not a condition of receiving any services or obtaining a loan. Message and data rates may apply. Message frequency varies. You can opt out at any time by replying STOP to any text or calling 615-610-3253. A current list of participating lenders is available upon request.

6. Equal Opportunity

Hard Money Lenders of Nashville connects borrowers with lenders who are Equal Opportunity Lenders. Participating lenders do not discriminate on the basis of race, color, religion, national origin, sex, familial status, disability, marital status, or age.

7. Acceptable Use

You agree not to:

• Use the Site in violation of any applicable law or regulation;
• Submit false, misleading, or inaccurate information;
• Submit information about another person without authority to do so;
• Interfere with or disrupt the Site or any systems or networks connected to it;
• Attempt to gain unauthorized access to any portion of the Site;
• Use automated means (bots, scrapers, harvesters) to access or collect information from the Site; or
• Use the Site to harass, abuse, impersonate, or defame any person or entity.

8. Intellectual Property

The Site, including its content, design, logos, trademarks, graphics, and code, is owned by Lead Skills, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, or transmit any material from the Site without our prior written consent.

9. Third-Party Links and Services

The Site may contain links to, or interoperate with, third-party websites and services, including participating lenders. We do not control and are not responsible for the content, privacy practices, or terms of those third parties. Your interactions with participating lenders and other third parties are solely between you and those parties.

10. Disclaimers

THE SITE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT YOU WILL BE MATCHED WITH A LENDER, RECEIVE A LOAN OFFER, OR OBTAIN FINANCING ON ANY PARTICULAR TERMS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LEAD SKILLS, LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE SITE OR ANY MATCHING WITH A PARTICIPATING LENDER, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY.

12. Indemnification

You agree to defend, indemnify, and hold harmless Lead Skills, LLC, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site, your inquiry, your violation of these Terms, or your violation of any law or third-party right.

13. Governing Law

These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law principles. Any action arising out of or relating to these Terms or the Site shall be brought exclusively in the federal or state courts located in Nashville, Tennessee, and you consent to the personal jurisdiction of those courts.

14. Changes to These Terms

We may modify these Terms at any time. When we do, we will post the updated Terms on this page and update the "Last Updated" date. Your continued use of the Site after the update constitutes acceptance of the revised Terms.
